Terms & Conditions

Overview

These Terms and Conditions describe your rights and conduct in connection with your use of the Monticello Coworking Space services provided by the San Juan County Economic Development and Visitor Services Department in connection with your Membership or Drop-in Fee for Shared or Private Desks, Conference Room, or other services.

Who we are

We create online and physical communities for businesses, non-profit organizations, visitors to San Juan County or the general public. For these terms, we are the Monticello Coworking Space on your invoice and are located at 80 North Main Street, Monticello, Utah. The relevant entity with which you enter into these Terms shall be known in these Terms as "we," "our," "us," or "Monticello Coworking Space."

Creating Your Membership

Passwords & keycards

Don't reveal your access code to anyone else. You are responsible for maintaining the confidentiality of your access code. You must promptly notify us if you suspect your access code has been compromised. Security of the space is of the utmost importance and we are wanting to keep it that way. We have installed security cameras and are recording what takes place in strategic areas. Please do not share your codes, we want to make sure that the visitors to the space are truly authorized to be there as well as responsible to the rules and conduct of the space. 

Linking to a company or business

During the registration process, you may identify a Company with whom your profile is associated. You agree that you will not falsely represent your association with any Company, impersonate any third party, or otherwise submit false information to the Monticello Coworking Space community or the San Juan County Economic Development and Visitor Services Department. If your relationship with the Company in your profile changes or ends, you agree to update your profile to reflect this promptly; you may submit a request to do so with the Monticello Coworking Space manager at mcoworking@sanjuancounty.org. If a Company provides your Membership or drop-in fee, you will lose access to the services upon termination with your linked Company.

Paying for Your Membership or Drop-In Fee

Payments

By signing up for Membership, Drop-In, or Conference/Presentation Room reservations, you agree to pay Monticello Coworking Space the recurring or nonrecurring fees associated with the particular services you purchase. We will update prices by schedule and from time to time upon notice to you. Membership fees will be charged on the first (1st) of each month. Overage fees and additional nonrecurring fees will be charged within thirty (30) days of you accruing such costs. 

If payment for your Membership Fee or any other accrued and outstanding fee is not made by the tenth (10th) of the month in which such payment is due, you will be responsible for paying the then-current late charge. The current late fee is the current Drop-In cost for each day you are late. Your use of the services may be immediately suspended and eventually terminated if your account isn't brought current promptly. 

When we receive funds from you, we will first apply the funds to any balances in arrears and to the earliest month due first. Once past balances are satisfied, any remaining portion of the funds will be applied to current fees due. 

No refunds

All fees are non-refundable. All payments must be paid as specified by Monticello Coworking Space.

Using and Terminating the Services

House Rules

House Rules governing the expected behavior while at the Monticello Coworking Space. The expectation is that you will not perform any activities reasonably likely to disrupt, damage, or be dangerous to us, our employees or agents, other members, guests, or any other third parties or property of any of the preceding. No pets are allowed. Illegal actions or activities, or those that appear to reflect negatively on San Juan County are prohibited. Service Restrictions

Your membership is for you exclusively. Do not share your credentials or access code with any other individual. Furthermore, you must not use any services or any space you reserve or occupy in a "retail," "medical," or other nature involving frequent use by or visits from members of the public unless approved by the director.

Drop-In Reservation vs. Membership 

  • If you have purchased a membership, you will have 24/7 access to the building with a personal building access code.
  • Drop-In members will have access to any desks on the Premises that are available for reservation. Reservations are made through the online Proximity workspace platform. Drop-In reservations can only be made during Regular Business Hours on Regular Business Days.
  • Regular Business Hours are from 8:00 a.m. to 8:00 p.m. (MST) Monday through Friday, except for government holidays when hours will vary.  See posted hours, or contact Monticello Coworking Space Director at: mcoworking@sanjuancounty.org for details.
  • Drop-In reservations can be paid daily or weekly.
  • All desk reservations are subject to desk availability.

 

You may be required to present a valid, government-issued photo identification to gain access to our Premises. For security purposes, we record via video certain areas. If necessary, we may disclose information applicable to law enforcement or legal process to protect us, our members, or any of our, or their, property. 

Conference Rooms & Workspaces

You may schedule the use of workspace and conference rooms during Regular Business Hours on Regular Business Days, all subject to the availability of such workspaces or conference rooms. The use of our workspaces and conference rooms above are subject to the standard fees. Such Fees are subject to change from time to time.

Property

For your convenience, we provide a limited number of lockers for our guests. We are not responsible for any property you leave behind. It is your responsibility to ensure that you have retrieved all of your personal items before leaving. Before the termination or expiration of your Membership and/or Drop-In reservation, you must remove all of your property from the Monticello Coworking Space. You will have two days (48 hours) to remove all personal items from the Monticello Coworking Space after your membership or reservation ends. We will officially notify you at the end of your membership or reservation to remove all personal items. If we have not heard from you, we will be entitled to dispose of any property remaining and you waive any claims or demands regarding such property or our handling of such property. You will be responsible for paying any fees reasonably incurred by us regarding such removal.

Damage

You may be held liable (and do hereby authorize us to charge you) for the repair cost for all damage to our Premises and items therein caused by you, your guests, or invitees.

Kitchen/Common Area

If you are accessing our space according to these terms, the kitchen/common area is to be accessed by you. To the extent we permit your guests, they are allowed to access the kitchen/common area during your reserved time. The kitchen/common area is for temporary use and not as a place for continuous, everyday work. The kitchen/common area is to remain clean. The refrigerator and any other food storage containers will be cleaned out every day. It is your responsibility to clean up after yourself and/or any of your guests immediately following use of the kitchen/common area. Failure to do so may result in termination of your membership or Drop-In access to the Premises.

Intellectual Property of others

You must not directly or indirectly take, copy or use any information or intellectual property belonging to other members or member companies or any of their guests, including without limitation: personal names, likenesses, voices, business names, trademarks, service marks, logos, trade dress, other identifiers or other intellectual property, or modified or altered versions of the same.

Technology Release

We may need to install software onto your computer, tablet, mobile device, or other electronic equipment to provide you with services (Proximity App, etc.). You acknowledge that your refusal to install such software may affect your ability to properly receive the services you have purchased. You agree that we: 

  • Are not responsible for any damage to any of your electronic equipment or systems related to software installation; 
  • Do not assume any liability or warranty if any manufacturer warranties are voided; and 

Furthermore, you acknowledge that you have no expectation of privacy concerning Monticello Coworking Space's internet connection, networks, telecommunications systems, or information processing systems (including any stored computer files, email messages, and voice messages). Your activity and any data or messages on or using any of those devices or systems will be monitored, including, but not limited to: security reasons and to ensure compliance with Monticello Coworking Space’s policies, regardless of whether such activity occurs on equipment owned by you or us.

You and other members

We do not control and are not responsible for the actions of other members or any other third parties. If a dispute arises between members or their invitees, or guests, we shall have no responsibility or obligation to participate or mediate.

Account termination

If you fail to comply with any of these Terms, and we, in our reasonable discretion, seek to do so, we may restrict your access to your membership or Drop-In privileges and/or terminate your membership or Drop-In privileges with immediate effect and possibly without prior notice to you. We may decline to renew your subscription for any or all services at the end of your membership or Drop-In period. You can cancel your membership at any time by submitting a request at: mcoworking@sanjuancounty.org. Please note that if a Company created your account and an authorized representative of such Company wishes to terminate your account by contacting us, we may terminate your membership, even if the Company's membership remains active, and even if you continue to be employed or engaged by such Company. 

Cancellation will be effective immediately upon our receipt of notice of cancellation. You will remain liable for past due amounts, and we may exercise our rights to collect due payment, despite termination or expiration of your Membership and/or Drop-In reservation. 

Endorsements and Testimonials

Endorsements and Testimonials

We may also publish testimonials by users and members related to their experiences with the Services from time to time. These testimonials are the users' subjective opinions, and they represent individual results. We neither verify them nor claim that they are typical results that others will generally achieve. Names, locations, dates, and other information may have been changed to protect the individuals' privacy. 

Use of the Monticello Coworking Space Name; Photos of the Premise

You may not take, copy or use for any purpose the name "Monticello Coworking Space" or any of our other business names, trademarks, service marks, logos, trade dress, other identifiers, or other intellectual property or modified or altered versions of the same, or take, copy or use for any purpose any pictures or illustrations of any portion of any Monticello Co Working Space property, without our prior written consent.

Limitations of Liability

Waiver and Release of claims

To the extent permitted by law, you, on your behalf and behalf of your employees, agents, guests, and invitees, waive any claims and rights against us and our landlords, their employees, assignees, officers, agents, and director resulting from injury or damage to, or destruction, theft, or loss of, any property, or person and release the Monticello Coworking Space from any such Claims. 

We are not liable for the actions of other individuals

We do not control and are not responsible for the actions of other individuals using the services. You should be aware that other users or members may not be who they claim to be. We do not perform background checks on our users or members nor guarantee that our users’ or members’ profiles are accurate. We do not endorse, support, or verify our users’ or members' facts, opinions, or recommendations.

We do not have liability for third-party products or services

The services may provide you with access to third-party products or services. The services may also provide you with access to advertisements from our other third-party business partners. We are not responsible for the content of these advertisements or any links, products, services, or other materials relating to any third-party products, services, publications, or other materials. 

You agree to cooperate with us

We may investigate any actual, alleged, or potential violations of these Terms from time to time. You agree to cooperate fully in any of these inquiries. You waive any rights against the Monticello Coworking Space Parties and agree to hold them harmless in connection with any claims relating to any action taken by us as part of our investigation.

Additional Terms Applicable to Services for Traveling Users

What are the Services we offer to travelers in our area? 

Our offer to travelers may include:

  • A discount rate to Monticello Coworking Space’s shared workspace during the regular business hours of the applicable Premises,
  • A discount conference room rental and 
  • Printing allowance to be used during the time of your Drop-In reservation, and
  • Additional access to Monticello Coworking Space’s Services by purchasing add-on Services through your Monticello Coworking Space account.

How can Traveling users qualify for the Monticello Coworking Space’s discount Drop-In rate?

To be eligible for the offer: 

  • You must have made an eligible Airbnb or like rental site booking, local hotel booking, local RV park reservation; 
  • Your accommodations must be within the Monticello area, including lodging that is near to, but a reasonable distance outside of Monticello, Utah’s city limits; 
  • All desks and conference spaces are booked based on availability. 
  • You may only use the Drop-In reservation during your stay (between your check-in and check-out dates); and 
  • Monticello Coworking Space can terminate the offer at any time.

San Juan County reserves the right to cancel any memberships at any time, upon cancellation, refunds may be provided unless there has been proven neglect or non-adherence with these rules and procedures.
